1. Introduction
Welcome to OpenResourceCommons ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at openresourcecommons.sbs (the "Service") operated by OpenResourceCommons.
By booking a charter or accessing our Service, you agree to be bound by these Terms. If you disagree with any part of these terms, then you may not access the Service.
2. Service Overview
OpenResourceCommons offers a range of upscale yacht charter services, which include but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
All services are subject to availability and prevailing weather conditions. We reserve the right to change or discontinue services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, the following requirements must be met:
- Minimum age of 18 years
- Submission of accurate and complete information
- Down payment as outlined in your reservation confirmation
- Acquiescence to these Terms & Conditions
3.2 Confirmation
Confirmation of your reservation is only secured upon payment and the issuance of our confirmation in writing. Service can be withheld from any individual at our discretion.
3.3 Availability
All bookings are dependent on the availability of vessels and agreeable weather conditions. Efforts will be made to accommodate your preferred dates and times.
4. Payment Terms
4.1 Pricing
Prices are provided in € and include all taxes, unless stated otherwise. Prices are liable to changes which may be introduced without notice.
4.2 Payment Schedule
- Initial payment: 50% of the overall cost of the charter, payable at the time of booking
- Final payment: The remainder is due 48 hours before the departure of the charter
- Additional fees (if applicable): Settled post-charter
4.3 Payment Methods
We accept a range of payment methods, including the main credit cards, wire transfers, and verified cheques. All payment processing is conducted using secure and encrypted systems.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- With over 72 hours notice before departure: Full refund minus transaction fees
- Between 24 and 72 hours notice before departure: 50% refund
- Less than 24 hours notice before departure: No refund provided
5.2 Inclement Weather Cancellations
In the case of weather being deemed unsafe for navigation by our captain, the options are to:
- Reschedule the charter to an alternative date without added fees
- Issue a complete refund where rescheduling is impossible
5.3 Mechanical Failures
If mechanical issues arise with the designated yacht, we will attempt to arrange an appropriate alternative. Should no suitable option be available, a total refund will be furnished.
6. Safety and Conduct
6.1 Safety Obligations
All guests are under obligation to:
- Comply with all directions given by the crew
- Utilize safety gear as required
- Communicate any medical conditions which could impinge on their safety
- Keep within certoain parts of the yacht as indicated
6.2 Prohibited Items
The items below are not allowed on board:
- Glass containers
- Illegal substances
- Firearms or other weapons
- Pets (exception made if pre-authorized)
6.3 Expectations of Behavior
Guests are expected to behave in a manner that is respectful. We reserve the right to halt a charter prematurely without a refund in instances where behavior endangers safety or detracts from the enjoyment of others.
7. Liability and Insurance
7.1 Our Responsibility
Our liability is confined to the cost paid for the charter. We are not responsible for:
- Injury stemming from the negligence of guests
- Loss or damage to personal belongings
- Indirect or secondary damages, nor punitive ones
- Delays owing to weather or circumstances outside our control
7.2 Insurance
Comprehensive marine insurance is in place for our vessels and operations. Passengers are advised to have their own personal and travel insurance arrangements.
7.3 Acceptance of Risk
Partaking in our charter services signifies your acknowledgment of the inherent hazards of maritime activities and your assumption of responsibility for your personal safety and security.
8. Itinerary Modifications
We hold the right to alter itineraries, routes, or timetables as a result of weather patterns, safety concerns, or operational demands. Efforts will be exerted to ensure a similar service experience is provided.
9. Events Beyond Our Control
Should events arise beyond our control, we cannot be held liable for any delays, cancellations, or changes they may cause. Such events could encompass:
- Severe meteorological conditions
- Natural disasters
- Regulatory enactments
- Closure of ports
- Mechanical breakdowns
10. Privacy and Personal Data
Your personal data will be treated as described in our Privacy Policy. Use of our services constitutes your consent to the gathering and usage of your information as laid out in our Privacy Policy.
11. Copyrights and Trademarks
All website contents, such as text, graphics, logos, and photographs, are under copyright and trademark protection. Reproduction, distribution, or creating derivative content without our explicit consent is prohibited.
12. Governing Legislation
The laws of Montenegro preside over these Terms. Any disputes will be adjudicated in the courts within Tivat, Montenegro.
13. Term Amendments
We retain the discretion to modify these Terms at our discretion. Any changes will be published on our website, complete with an update to the revision date. Continued patronage of our services signifies acceptance of the amended terms.
